QUESTIONS

Can I get an uncontested divorce faster in Nevada?

I am from the Philippines and I came to the U.S. on a fiancé visa. I married here in Arizona and the marriage is not working out. My wife and I own no property together and we have no children. I want a divorce as quickly as possible so I can go back to the Philippines and not have to return to the U.S. for any divorce proceeding. A friend told me you only have to reside in Nevada for a short period of time to be considered a resident and get a divorce there. How quickly can I get a divorce in Nevada and how long do I actually have to live there to qualify? I can easily get a job in Las Vegas for a short period of time and establish residence there if necessary.

QUESTIONS

Will a prenup protect my retirement benefits?

I am engaged and want a prenuptial agreement. I have a substantial pension with a corporation I work for in Houston. My company has advised me that once I marry, my spouse automatically becomes the beneficiary of my pension. She would have to voluntarily waive her interest after we marry. I don’t want to take the chance that she would refuse to sign off once we are married. I want to advise her that I will not proceed with the wedding unless she signs a prenup giving up any interest in the pension. I am also concerned because I am told Texas is a community property state and once married, we would share everything 50/50. Will a prenuptial protect my pension in the event of a divorce?

QUESTIONS

Will a judge consider my religion in a child custody matter?

I am Filipino and a devout catholic. Religion was just as important to my ex-wife during our marriage but since our divorce, she has left the church and no longer has faith in God. We are in a custody case involving our daughter and I want to ask for full custody of her because I believe it is important for our daughter to be raised in the church. If her mother has her, she won’t get any religious education. In this custody case, will my religious faith and my desire to raise my daughter as a Catholic matter to a judge in the final decision?

QUESTIONS

Can we pay expenses for a birth mother in an adoption?

My wife and I want to adopt and we’ve been approached by a woman in our church who is pregnant and cannot keep the baby. She is not in a good situation financially and has asked us if we are able to assist her with expenses. If we do not, she will need to leave Sacramento and go live with her parents in Seattle during her pregnancy. We do not want that, we prefer her to be close by so we can monitor the pregnancy and attend doctor’s appointments with her. We think we are legally allowed to pay for her medical expenses for the birth, but does California law permit us to provide her things like rent and food? Should we have some sort of contract stating the terms of the adoption? We are Filipino and so is she, so it’s important to us to work with a Filipino lawyer if we do need one.

QUESTIONS

Can I get a divorce and child support in the U.S.?

We were married in the Philippines but moved to the U.S. shortly after. Our children were born here in the states in Chicago. I now want a divorce due to mental cruelty of my husband to me and my children. I don’t know if we ever registered our marriage here. Can I get a divorce and child support here or does it have to be through the Philippines? I need to know what my rights are. How will child support be calculated for my children?
